1. Terms of website use

1.1 These terms, together with the privacy policy and cookie policy and any other documents referred to, set out the terms and conditions of use of the University for the Creative Arts website https://www.uca.ac.uk and its subdirectories and subdomains (‘the Website’), and apply to all users and visitors to the Website (‘you’).

1.2 The Website is operated by the University for the Creative Arts (‘we’, ‘us’) whose principal office is at Farnham Campus, Falkner Road, Farnham, Surrey, GU9 7DS. We may be contacted at this address by letter for the attention of the webmaster or by e-mail at web@uca.ac.uk

1.3 We may change these terms, the privacy policy and any other documents referred to in the terms, at any time, and any changes will take effect immediately from the time the Website is updated. Your continued use of the Website will be deemed to be acceptance of the updated terms. Please check this page from time to time for any changes we have made to these terms, as they are binding on you without further notice.

2. Security

2.1 You must not harm, or attempt to harm, the integrity, security and/or availability of the Website.

2.2 You must not send or upload any data or material that contains viruses, Trojan horses, worms, spyware or any other harmful programmes or code designed to adversely affect the operation of any hardware or software.

2.3 If you believe that the integrity and/or security of the Website has been, or is at serious risk of being harmed, you must notify us immediately on telephone number 01252 722441.

2.4 You agree to fully indemnify us against all liabilities (including, but not limited to, legal and other professional fees and expenses) which we may incur in connection with a breach of this clause 2. You accept all responsibility and liability for any loss or damage of any kind resulting from your conduct.

3. Intellectual property and use of Materials

3.1 This Website contains materials which, unless otherwise stated, are owned by or licensed to us. These materials include, but are not limited to, the design, layout, look, appearance and graphics of the Website, and any documents, templates and reports owned or licensed by us and contained thereon ("the Materials"). The Materials are protected by intellectual property laws including, but not limited to, copyright and trademark laws.

3.2 Unauthorised use of the Website and/or the Materials may give rise to a claim for damages and/or be a criminal offence.

3.3 The Website and the Materials have been made available to you for personal and domestic use only.

3.4.1 view and display the Materials; and

3.4.2 print and/or download to a local or network drive extracts from, or whole pages of, the Materials, for your personal use.

4.1 Our Website has been prepared with the primary aim of providing general information for and about the University, detailing what we do and how we do. Although we try to ensure that this general information is accurate at the time of publication, any information on our site may be out of date or incomplete at any given time. If you believe that any information on our site is inaccurate please let us know and we will investigate this. The University disclaims all liability and responsibility arising from any reliance on such general information by any visitor to our site, or by anyone who may be informed of any of its contents.

4.2 For potential applicants, information relating to specific courses can be found on the course pages on the Website. The content may be subject to change and the University takes reasonable steps to provide the most up to date programme specification and related fees information on the Website.

5. Linking

5.1 The Website contains links to third-party websites. We have no control over the content of third-party websites and we accept no responsibility or liability for their content or for any loss or damage that may arise from your use of them. You must carry out your own checks to ensure the accuracy of any information posted by third parties.

5.2 Any link to a third-party website is not , nor should it be construed as, an endorsement of any kind by us of that website or the content of, or merchandise offered by, that website.

5.3 You may not create a link to the Website from another website or document without our prior written consent.

6. Limitation of our liability

6.1 We do not guarantee that use of the Website will be compatible with all hardware and software which may be used by visitors to the site or that the Website will be available all the time or at any specific time. We reserve the right to withdraw or modify the Website at any time. You are responsible for configuring your own IT equipment in order to access the Website, and you should use your own virus protection software.

6.2 We cannot guarantee that the Website will be uninterrupted or error-free, or free of viruses or other harmful programmes or codes designed to adversely affect the operation of hardware or software.

6.3 We give no warranty or representation to you about the Website and the Materials except those which are expressly stated in these terms.

6.4 Except as set out in this clause 6, we will be under no liability to you whatsoever whether in contract, tort, (including negligence), breach of statutory duty, restitution or otherwise for any injury, death, damage or direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits (whether direct or indirect), loss of business, depletion of goodwill and like loss) howsoever caused arising out of or in connection with the use of the Website or the use, accessing, downloading or relying on the Materials, any information or other materials contained in the Website, including, without limitation, as a result of any computer virus.

6.5 If you are a consumer, please note that we only provide the Website for personal and domestic use and will not be liable to you for any loss of profit, loss of business, interruption to business or loss of commercial opportunity.

6.6 We do not in any way exclude or limit or liability for:

6.6.1 death or personal injury caused by our negligence;

6.6.2 fraud or fraudulent misrepresentation; or

6.6.3 any breach of the terms for which liability cannot be limited or excluded, under section 57 of the Consumer Rights Act 2015.

7. Jurisdiction and applicable law

The Website is controlled and operated by us from our address in England. The formation, existence, construction, performance, validity in all aspects whatsoever of these terms or of any part of these terms or any dispute in relation to the Website or the Materials shall be governed by English law. The English courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms or use of the Website.
